TERMS OF SERVICE AGREEMENT

Welcome to ALMAMATCH (hereinafter, "the Platform", "we", "our" or "us").
This Terms of Service Agreement (the “Agreement”) governs your access to and use of our Platform, which is designed to facilitate interaction, communication, and connections between individuals interested in social or romantic relationships.
By accessing, registering, or using the Platform, you expressly and unconditionally agree to be bound by this Agreement and our Privacy Policy.
If you do not agree to these terms, please do not use our services.
For the purposes of this Agreement:
Platform: The website, mobile application, and digital services we offer.
User: Any person accessing or using the Platform.
User Content: Any information, images, videos, messages, posts, calls, or communications generated by the User.
Services: Communication features (chats, voice calls, virtual gifts, etc.) and other tools made available through the Platform.
By creating an account or using any part of the Services, you agree to be legally bound by this Agreement.
Continued use of the Platform shall be deemed acceptance of any modifications we may introduce to this Agreement.
The Platform is strictly intended for individuals who are 18 years of age or older.
By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.
We reserve the right to request age verification at any time and to remove accounts that fail to meet this requirement.
You must complete the registration process by providing accurate, truthful, and up-to-date information.
You are responsible for maintaining the confidentiality of your password and for all activities conducted through your account.
Creating multiple accounts or transferring accounts without prior authorization is strictly prohibited.
We reserve the right to suspend or terminate accounts suspected of fraud, identity misrepresentation, or misuse.
You agree to:
Refrain from harassing, intimidating, threatening, or defrauding other users.
Avoid posting illegal, obscene, defamatory, violent, or infringing content.
Not use the Platform to solicit money, sexual services, or for unauthorized commercial purposes.
Avoid sharing sensitive personal information (such as bank account numbers or passwords) publicly within the Platform.
Not send spam, automated content, viruses, or malware.
Serious or repeated violations may result in the immediate termination of your account without refund.
The Platform offers:
User Profile: Create and personalize your profile.
Private Chats: Real-time messaging between users.
Voice Calls: Voice communication between users.
Sending Virtual Gifts: Interact in a special way with other users.
Credit System: Access to premium services through the purchase of credits.
Some functionalities may require the use of credits or paid subscriptions.
Credits: Users may purchase virtual credits to access specific features.
Subscriptions: Some premium services are available through monthly or periodic subscriptions.
Automatic Renewal: Subscriptions may automatically renew unless canceled by the User prior to the renewal date.
Refunds: All purchases are final. No refunds will be issued for unused credits or active subscriptions unless required by applicable law.
The User is responsible for reviewing the purchase terms before making any transaction.
You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute such Content within the Platform.
You represent and warrant that you have the necessary rights to all Content you upload or share.
We reserve the right to remove or block any Content that we deem inappropriate, illegal, or in violation of this Agreement.
We reserve the right, but not the obligation, to monitor activities within the Platform to ensure compliance with this Agreement.
We may:
Remove Content that violates our policies.
Temporarily suspend accounts for internal investigations.
Permanently terminate accounts for serious or repeated violations.
Users may cancel their accounts at any time through the account settings options.
We reserve the right to suspend or terminate accounts for violation of these Terms or for illegal or inappropriate behavior.
Account cancellation or suspension does not entitle the User to any refund of payments made.
Our collection, storage, and use of personal data is governed by our Privacy Policy, which forms an integral part of this Agreement.
By using the Platform, you agree to our Privacy Policy.
All elements of the Platform (texts, graphics, interfaces, logos, software) are the exclusive property of Yesenia Torres (or her legal successor).
Copying, distributing, modifying, or exploiting these elements without express authorization is strictly prohibited.
The Platform is provided "as is" and without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee specific outcomes or uninterrupted availability of the service.
Under no circumstances shall we be liable for:
Loss of data, profits, or reputation.
Damages arising from interactions between users.
Technical failures, service interruptions, or errors.
Our total liability, under any circumstance, shall not exceed the amount the User has paid to us in the last 12 months.
You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:
Your misuse of the Platform.
Your breach of this Agreement.
Your violation of the rights of third parties.
We reserve the right to amend these Terms at any time.
Modifications will be communicated through publication on the Platform and will take immediate effect.
Continued use of the Platform after changes implies acceptance of the new Terms.
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, United States.
Any disputes arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the competent courts in New York.

If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between the User and us regarding the use of the Platform.
The official language of this Agreement is Spanish. In case of discrepancies, the English version shall prevail.
